We are pioneer in Smart and Modern Agriculture focusing in peppers production in the country, Malaysia. Our aim is to have numerous operational sites and farms in every state in Malaysia through the implementation of an IOT system intergrated with Green House infrastructures and facilities. Today, we offer a wide variety of high quality peppers, naturally nutritious plant-based foods that are conviniently prepared and packaged for you and your family to enjoy for any meal occasion. 356 days of the year, we're growing fresh, local produce.

When we first started, the State Exco, YB Rodziah came and visited our small farm as a sign of support from the state government. We have established a collaboration with the Ministry of Rural Development (Malaysia) through Pertubuhan Kebajikan dan Pembangunan Luar Bandar Malaysia, where we started off our first mega scale smart farming project in Kenaboi, Jelebu, Negeri Sembilan covering 100 acres of land.

Terms & Conditions

LEvery agent shall adhere to the terms and conditions apply in this Agreement. A fee MYR200.00 shall be paid to Premium Peppers Marketing (Maybank: 5624-5012-3941) upon registration. Agent Registered Number (ARN) and agent code will be provided differently for every selected agent upon confirmation. The ARN and agent code shall be used at all times, to purchase an order for the financial department to record.

ORDERS

A minimum of RM200.00 order is required. Please note that FHP will provide different peppers products, subject to availability, to the agents upon first registration.
No yearly fee is required. Registration fee is once for a life time.
All orders can be made by walking in to our farm sites, via agent platform or through www.freshharvestpeppers.com only.
Agent shall contact FHP Sales Admin at 017-1371367 to obtain discount or special promotion code prior to finalising the purchase.
Payment is strictly Cash Before Delivery(CBD) basis. Payment can be made via online banking or cash.

RETAIL PRICE
The agent is required to follow the retail price as set by FHP. No deviation of pricing is permissible without informing FHP in the first place. Failure to comply would amount to a breach of contract and action will be taken against the agent,
Farm price, wholesale and recommended retail prices may fluctuate due to market forces and we reserve the right to alter them periodically.
Discount cannot be applied to our products without our prior written consent.

MARKETPLACES SELLING/THIRD PARTY
The agent is permitted to resell the items/goods/products to customers via offline and online platforms.
FHP reserves the right to protect its product brand and the brands it carries and determined where the product is/should be sold. FHP must be notified prior to products being advertised through/on third party stockists and marketplaces such as Shopee. Lazada, eBay, Amazon, Alibaba etc. and we reserve to block any of our products being advertised on such sites if it is against any law or community rights. Failure to notify FHP and obtain prior agreement will result in sanction placed on product availability, future order cancellation, and/or further legal actions being taken to have the item removed from third party sellers/marketplaces.
The agent agrees that the product of FHP will be sold by the agent direct to consumers and not in bulk for the purposes of reselling.
In the event we have reasonable grounds to believe that the agent has acted in breach of these Terms and Conditions, we may forfeit withdraw our permission for the agent to sell FHP product and the agent will no longer be entitled to sell our product or be a part of Premium Peppers Marketing team.

COMMUNICATION
An online website store; www.freshharvestpeppers.com is maintained by FHP for the purposes of providing extensive product information and setting the RRP of all products available under FHP. All information contained therein are exclusive intellectual property of FHP. Any alteration made to the information provided, whether knowingly or not will be considered as breach of contract and may be liable for action taken.
For the purposes of communication and advertising/marketing, FHP and Premium Peppers Marketing has an active presence in the major social media channels. All stokists/agents are encouraged to follow/like the said social pages in order to obtain customer feedback, promotions and other marketing activities. Undesired social media behavior such as spamming will not be tolerated.

DELIVERY
Goods will be delivered to the address nominated by you at the time of ordering. For orders dispatched, please make order at least 1 day before delivery date. Delivery is only available for Malaysia.
Notification by email/messages will be sent prior to shipping to confirm delivery address and to provide trackers.
Self-Collection is also available at designated farm sites specified by FHP.

RETURNS
All perishable items sold are non-exchangeable and non-returnable. However, should there be any production fault in the item, we will replace the item provided notice is provided within 7-days within receipt of order. This policy does not cover any damage caused by the customer due to negligence or stress on the item concerned. In the case of damage caused by the customer, FHP and Premium Peppers Marketing will not be held liable.

CANCELLATION
We reserve the right to cancel or suspend the order at any time if the agent becomes bankrupt or insolvent, enters into any arrangement with the creditors, or being a company, goes into liquidation or is wound-up, or being a partnershipisdissolved or if, in our reasonable opinion, one of the aforementioned events is likely to occur. The agent must notify us in writing immediately if any one of the aforementioned events occurs.
The agent is restricted and not allowed to promote or sell other product or brand of other company of the same nature whilst still being a registered agent under FHP. If we feel that our reputation and company standards are being damaged while continuing a business relationship, we also reserve the right to terminate our relationship with a 30 days’ notice.

GENERAL
All product branding, logo design and packaging are protected by international rights of copyright. Any use of copyrighted material without prior notice and agreement FHP will be considered a breach of copyright and legal action will be taken.
The agent will not, without our prior written consent, allow any of our logos or trademarks or other words or marks applied to products imported/developed by FHP to be obliterated, covered, obscured or omitted or to add any additional words or marks.
The agent will not, repack or knowingly allow repacking of the products or in any way, make any alterations to the original product or its packaging. Any alterations made will constitute a breach of copyright and legal action will be taken.
No delay or failure on our part to enforce our rights or remedies under these terms and conditions shall constitute a waiver on our part of such rights and remedies unless such waiver is confirmed in writing.

OUR COMMITMENT
As agent, you must notify us immediately if you find any of our products supplied to be defective in any way (which must be no later than 24 hours of receipt of the Order) and allow us an opportunity to investigate and/or replace (if applicable).
Where we have agreed that the Goods are defective then we will supply suitable replacement goods free of charge and arrange for the return of defective product(s)/item(s).

LIMITATION OF LIABILITY
FHP shall not be held liable for any failure or delay in delivering the Goods where such failure arises as a result of any act or omission which is outside FHP’s reasonable control such as act of God, pandemics, Government order pertaining to movement restriction orders due to Covid-19 outbreaks, or those of a third party.
FHP shall not be held liable for third party misrepresentations of FHP products or third party fraudulent misrepresentations.
Should either party decide that a business relationship can no longer be amicable and no reasonable compromise can be reached, termination of a business relationship will require a 30-day notice period in writing and the agent shall be liable for any orders or outstanding payments due within that notice period (if any).
